Terms & Conditions

These Terms & Conditions ("Terms") are an agreement between you and Blue Sky Ventures ("Blue Sky," "we," "us"), the operator of bluesky-cbd.com (the "Site"). By using the Site or placing an order, you accept these Terms. If you do not agree to them, do not use the Site.
1. Who may purchase
You must be at least 18 years old — or 21 where your local law requires — to purchase from the Site. By placing an order you represent that you meet this age requirement and that receiving hemp-derived CBD products is lawful at your shipping address. The Site is not directed at children, and we do not knowingly collect personal information from anyone under 13.
2. Our products — important information
Our products are hemp-derived CBD products containing 0.0% THC, third-party tested by batch, with certificates of analysis published on the Site. Please read the following carefully:
— Not medical advice. Nothing on the Site — including articles, research summaries, dosing guides, videos, and customer reviews — is medical advice, and our products are not intended to diagnose, treat, cure, or prevent any disease. These statements have not been evaluated by the Food and Drug Administration.
— Talk to your doctor. Consult a physician before use, especially if you are pregnant, nursing, taking medication, or have a medical condition. For products in our pet line, consult your veterinarian and follow the label.
— Individual results vary. Customer stories and reviews reflect individual experiences and are not a promise of your results.
— Drug screening. While our products are formulated with 0.0% THC and each batch is tested, we make no warranty regarding the outcome of any drug test, and you assume that risk.
— Use as directed. Follow label directions, and keep products out of the reach of children and pets (except pet products used as labeled).
3. Orders, pricing, and payment
All orders are offers to purchase, which we may accept or decline. We may refuse, limit, or cancel any order — including after confirmation — for reasons including suspected fraud, resale, errors in pricing or product information, or unavailability; if we cancel a paid order, we will refund it. We work to keep pricing and product information accurate, but errors occur; where an error is material to your order, we
will contact you to confirm or cancel. Prices are in U.S. dollars and exclude taxes and shipping, which are shown at checkout. You represent that you are authorized to use your payment method.
4. Subscriptions
Some products may be purchased on a subscription that renews automatically. By starting a subscription you authorize us to charge your payment method the stated subscription price, plus applicable taxes and shipping, at the interval you select, until you cancel.
— Cancel anytime. You can pause, skip, or cancel from your account portal at any time, or by contacting info@bluesky-cbd.com. Cancellation stops future charges; it does not refund orders already processed or shipped.
— Renewal notice and price changes. Your renewal date and price are shown in your account. If we change your subscription price, we will notify you by email at least 30 days before the change takes effect, and you may cancel before it applies.
— Failed payments. If a renewal payment fails, we may retry it and may pause or cancel the subscription.
5. Shipping
We ship to addresses within the United States only. Title and risk of loss pass to you when we deliver the order to the carrier. Delivery timelines shown at checkout are estimates, not guarantees. You are responsible for providing an accurate shipping address; we are not responsible for orders delivered to the address you provided.
6. Returns and refunds
We keep our return rules simple:
— Returns. Unopened, unused products in their original packaging may be returned within 30 days of delivery for a full refund of the product price. To start a return, contact info@bluesky-cbd.com with your order number; we will confirm eligibility and provide instructions. Refunds are issued to the original payment method after the return is received and inspected. Original shipping charges are non-refundable, and return shipping is your responsibility unless we shipped the wrong item or the item arrived damaged.
— Opened products. Because our products are consumable, we cannot accept returns of opened or used products.
— Damaged, defective, or incorrect orders. If your order arrives damaged, defective, or is not what you ordered, contact us within 30 days of delivery and we will replace it or refund you in full — no return required unless we ask.
— Subscriptions. Subscription orders follow the same rules. Cancelling a subscription stops future charges but does not refund orders already shipped.
— Requests made more than 30 days after delivery do not qualify for a refund.
7. Your account
You are responsible for maintaining the confidentiality of your account credentials and for activity under your account, and you agree to provide accurate information and keep it current. Accounts are personal and may not be transferred. We may suspend or terminate accounts that violate these Terms.
8. Rewards, gift cards, and promotions
Our rewards program, gift cards, and promotional offers are subject to the terms presented with them, which are part of these Terms.
— Gift cards are redeemable for merchandise on the Site, are not redeemable for cash except where required by law, and do not expire where prohibited by law.
— Rewards points and benefits have no cash value, are non-transferable, and may be modified or discontinued prospectively; earned rewards will be honored or wound down with reasonable notice.
— Promotional codes are limited to one per order unless stated, may have expiration dates and eligibility conditions, and may not be applied retroactively.
9. Wholesale and affiliate programs
Wholesale accounts and affiliate participation are governed by their separate agreements and program terms, which control over these Terms for those relationships.
10. Communications
By creating an account, placing an order, or signing up for our emails or texts, you consent to receive electronic communications from us, and you agree that electronic notices satisfy any requirement that communications be in writing. Transactional messages (order and subscription notices) are part of the service. Marketing emails and texts require your consent, which you can withdraw at any time —
unsubscribe links in email, or reply STOP to texts. Message and data rates may apply to texts.
11. Reviews and other content you submit
You keep ownership of reviews, photos, videos, and other content you submit, and you grant us a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, display, adapt, and distribute that content in connection with our business, including on the Site and in our marketing, with or without your first name and last initial. You represent that your submissions are your own, truthful, based on your genuine experience, and don't violate anyone's rights. We may decline to post, or may remove, any submission at our discretion, and we do not compensate for submissions. Do not submit content that is unlawful, infringing, deceptive, or that makes medical claims on our behalf.
12. Intellectual property and acceptable use
The Site and its content — text, graphics, logos, photography, video, design, and software — belong to Blue Sky or its licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Site for personal shopping and learning. You may not copy, scrape, resell, reverse engineer, or create derivative works from the Site or its content; interfere with the Site's operation or security; use the Site for unlawful purposes; or purchase products for unauthorized resale. Our products are not for resale except through our authorized wholesale program.
13. Third-party services and links
The Site uses third-party services (such as payment processors, subscription management, reviews, and email) to operate, and may link to third-party websites. We are not responsible for third-party sites or services, and your use of them is governed by their terms. Information sharing with our service providers is described in our Privacy Policy.
14. Privacy and cookies
Our Privacy Policy and Cookie Policy describe how we collect and use information and the choices you have, and are incorporated into these Terms by reference.
15. Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE AND ITS CONTENT, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THIS SECTION DOES NOT LIMIT THE REMEDIES IN SECTION 6 (RETURNS AND REFUNDS) OR ANY WARRANTY OR RIGHT THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, INCLUDING ANY NON-WAIVABLE RIGHTS YOU HAVE AS A CONSUMER.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM OR RELATING TO THE SITE OR THESE TERMS; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SITE, THE PRODUCTS, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (ii) ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR PERSONAL INJURY CAUSED BY A DEFECTIVE PRODUCT WHERE SUCH LIMITATION IS PROHIBITED.
17. Indemnification
You agree to indemnify and hold harmless Blue Sky and its officers, directors, employees, and agents from losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Site, your submissions, or your violation of law or third-party rights. We may assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate.
18. Dispute resolution — please read carefully
— Talk to us first. Before filing any claim, you agree to contact us at info@bluesky-cbd.com describing the dispute and give us 30 days to try to resolve it informally.
— Binding arbitration. Except as provided below, any dispute arising out of or relating to these Terms, the Site, or the products will be resolved by final, binding arbitration before a single arbitrator under the Consumer Arbitration Rules of the American Arbitration Association, governed by the Federal Arbitration Act. Arbitration will take place in Denver, Colorado, or remotely by videoconference at your election, and each party bears its own fees except as the AAA rules or applicable law provide otherwise. The arbitrator decides all issues except that a court decides the enforceability of the class-action waiver below.
— Small-claims carve-out. Either party may instead bring an individual claim in small-claims court.
— Opt-out. You may opt out of this arbitration agreement by emailing info@bluesky-cbd.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration.
— Class-action waiver. Disputes will be resolved on an individual basis only. Neither party may participate in a class, collective, consolidated, or representative action, and the arbitrator may not consolidate claims or preside over any representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim must proceed in court, and the remainder stays in arbitration.
— This Section survives termination of these Terms.
19. Governing law
These Terms and any dispute arising from them are governed by the laws of the State of Colorado, without regard to conflict-of-law rules, and — subject to Section 18 — the state and federal courts located in Denver, Colorado will have exclusive jurisdiction.
20. International visitors
We operate the Site from the United States and ship only to U.S. addresses. If you access the Site from elsewhere, you do so on your own initiative and are responsible for compliance with local law.
21. Changes to these Terms
We may update these Terms from time to time. The current version will always be posted on this page with its effective date, and material changes will be indicated by updating that date; for material changes affecting active subscriptions, we will provide notice by email. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
22. General
If any provision of these Terms is unenforceable, it will be modified to the minimum extent necessary or severed, and the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delay or failure caused by events beyond our reasonable control. These Terms, together with the policies they incorporate, are the entire agreement between you and Blue Sky regarding the Site.
